Broward Slip and Fall Lawyers

The distractions of children at play and the frailty of senior citizens often are blamed for slips and falls, but not all such injuries are caused by missteps of youth or the elderly. Hazards exist in the form of slippery or uneven walkways, inadequately lighted stairwells and public sidewalks bubbled by tree roots. Negligent property owners who ignore dangerous property conditions could be legally accountable for the safety of others.

Slip and Fall: By the Numbers

Nationally, slips, trips and falls account for 40 percent of all emergency room treatments. One in three patients is elderly and more than 2.8 million are children. [1] Joint strains and sprains affect 47 percent, back injuries account for 30 percent and fractures another 10 percent. [2]

State Law for Slip and Fall Cases

Florida recently introduced a law that includes a provision requiring fall victims to provide more than evidence of injury and accumulated losses to prove the negligence of a property owner. Courts must equally be convinced that a property owner created or was aware of unsafe conditions and did nothing to remedy the situation. [3] Therefore, a slip and fall investigation is necessary to discover what caused an injury and who might be at fault. Because a judge will consider how much a victim might have contributed to his or her own injuries through personal negligence, an experienced personal injury lawyer must carefully separate any overlap of reasons for an injury caused by a fall.

The pieces of an evidence puzzle -- photographs, witness interviews, injury-site conditions, building code inspections and documented past injuries on the property -- would be difficult, if not impossible, for a fall victim to gather alone. The guidance of a legal professional who knows what to ask, where to look and how to deal with insurance companies, commercial establishments and individual property owners is critical.

Experienced lawyers uncover more than missing handrails, darkened stairways, torn carpets, greasy puddles or stray cables. The slip and fall attorneys at Edward F. Holodak, P.A. serve clients throughout Broward County, including Pembroke Pines, Hollywood, Fort Lauderdale and Coral Springs.
